DMCA Policy
Roasted Roma Tomatoes respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the Roasted Roma Tomatoes service or website if such claims are reported to our Designated Copyright Agent identified below.
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Roasted Roma Tomatoes website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Filing a DMCA Infringement Notice
To file a DMCA Infringement Notice, you must provide a written communication that includes substantially the following:
- Identification of the copyrighted work claimed to have been infringed: Provide details such as the title of the work, and where possible, include a URL or other identifying information of the copyrighted work.
- Identification of the material that is claimed to be infringing: Provide sufficient detail to enable us to locate the material (e.g., URL of the specific page or content).
- Information reasonably sufficient to permit Roasted Roma Tomatoes to contact the complaining party: This includes your name, address, telephone number, and, if available, an email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA notice, we will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material that we have removed or disabled access to it.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may send us a counter-notification. Your counter-notification must be a written communication that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled: Provide the location at which the material appeared before it was removed or access was disabled (e.g., URL).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Roasted Roma Tomatoes may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA infringement notice. If the original complainant does not file an action seeking a court order against you within 10-14 business days of receiving the counter-notification, we may restore the removed material.
